Article 1 - Purpose

These Terms of Use (hereinafter "Terms") define the terms and conditions of use of the website TheSmartDad.com (hereinafter "the Site") published by BP Les Cannisses KFT.

Use of the Site implies full and complete acceptance of these Terms. If you do not accept these Terms, please do not use the Site.

Article 2 - Description of the Service

TheSmartDad is a free service connecting individuals (hereinafter "Users") with licensed family protection and life insurance advisors (hereinafter "Partner Advisors").

BP Les Cannisses KFT acts as a business introducer.

In this capacity, TheSmartDad:

  • Is not a licensed insurance broker or agent
  • Does not provide personalized advice on insurance matters
  • Does not compare insurance contracts
  • Does not make recommendations of products or insurance companies
  • Is strictly limited to connecting Users with Partner Advisors

Partner Advisors are independent professionals, duly licensed and authorized to carry out insurance brokerage activities in their respective states. They are solely responsible for the advice they provide and the contracts they offer.

Article 3 - Access to the Site

The Site is freely accessible to any User with an internet connection.

All costs required to access the Site (computer equipment, internet connection, etc.) are borne by the User.

BP Les Cannisses KFT reserves the right to modify, suspend or discontinue access to the Site, in whole or in part, temporarily or permanently, without notice or compensation.

Article 4 - Use of the Connection Service

4.1. Connection Process

To benefit from the connection service, the User must:

  1. Complete the contact form available on the Site
  2. Provide accurate and up-to-date information (first name, last name, email, phone, family situation)
  3. Agree to be contacted by Partner Advisors by checking the consent box

Once the form is submitted, the User's contact details are transmitted to one or more Partner Advisors selected by TheSmartDad.

A Partner Advisor will contact the User within 24 to 48 business hours, by phone or email, to discuss their situation and needs.

4.2. Free Service

The connection service is completely free for the User. No fees will be charged by TheSmartDad to the User.

Partner Advisors are paid by insurance companies when the User takes out a contract. This remuneration does not result in any additional cost to the User.

4.3. No Purchase Obligation

The User is under no obligation to take out an insurance contract after being contacted by a Partner Advisor.

The User is free to accept or refuse the proposals made by the Partner Advisor.

The User may at any time end the relationship with the Partner Advisor by informing them of their wish to no longer be contacted.

Article 5 - User Obligations

The User agrees to:

  • Provide accurate, up-to-date and complete information when completing the form
  • Not impersonate another person
  • Not use the Site for illegal, fraudulent purposes or contrary to these Terms
  • Not attempt to disrupt the operation of the Site or unauthorized access to BP Les Cannisses KFT's computer systems

In case of breach of these obligations, BP Les Cannisses KFT reserves the right to suspend or terminate the User's access to the Site, without notice or compensation.

Article 6 - Limitation of Liability

BP Les Cannisses KFT provides the Site and connection services on an "as is" basis. We do not guarantee:

  • Permanent availability of the Site
  • Absence of errors or bugs on the Site
  • Compatibility of the Site with all browsers and operating systems

BP Les Cannisses KFT is not be liable for:

  • Use made by Users of information on the Site
  • Acts, omissions or failures of Partner Advisors
  • Quality, content or compliance of advice provided by Partner Advisors
  • Non-subscription of an insurance contract following the connection
  • Direct or indirect damages resulting from use of the Site

Article 7 - Intellectual Property

All content on the Site (texts, images, graphics, logos, icons, sounds, software, site structure) is the exclusive property of BP Les Cannisses KFT or its partners, unless otherwise stated.

Any reproduction, representation, modification, publication, adaptation of all or part of the Site elements, by any means or process, is prohibited without prior written authorization from BP Les Cannisses KFT.

Article 8 - Applicable Law and Jurisdiction

These Terms are governed by the laws of the State of California, USA.

In case of dispute relating to the interpretation or performance of these Terms, and failing amicable agreement, the dispute will be brought before the competent courts of California.
